Consultation on the draft Statement of Licensing Policy 2021 - 2026

A new Statement of Licensing Policy will be adopted in July 2021. View the draft Policy here and give us your feedback on the changes within this Policy.

Overview

The Licensing Act 2003 regulates the provision of sale of alcohol, regulated entertainment and late night refreshment (hot food and/or drink between 23:00-05:00) in England and Wales. The Act makes Local Authorities responsible for licensing premises that are used for these activities within their area. It also requires each Local Authority to adopt and publish a Statement of Licensing Policy at least every five years. The purpose of the Policy is to set out the principles the Local Authority will apply when carrying out its licensing functions under the Act.

The Statement of Licensing Policy was last reviewed in July 2016 and is therefore due to be reviewed, with the new Policy coming into force in July 2021. We are currently consulting on the revised Statement of Licensing Policy, which takes into account any changes in guidance and best practice. The layout of the Policy has changed with additional sections added and the existing content revised where appropriate.

In 2018 the Licensing Authority created a ‘Night Time Economy Position Statement’ as an addendum to the Statement of Licensing Policy. This document contained additional information and explanations around ‘Licensing Decision Making relating to the Night Time Economy’. This document has now been integrated with the Statement of Licensing Policy so that all the relevant information can be found in one place.

Changes in the Draft Statement of Licensing Policy 2021-2026 include:

  • A new section on pre-application advice and engagement
  • Licensing Hours – Revised premises definitions and timings
  • Town Centres – Revised locations and the introduction of a Sensitive Licensing Area
  • Revised section on stakeholder engagement and representations
  • Revised section on enforcement and inspection

The above is not an exhaustive list of the changes within the draft Statement.

The current Statement of Licensing Policy 2016-2021 and NTE Position Statement can be found on our Licensing Act 2003 & Licensing Policy page.

In addition to the Draft Statement of Licensing Policy 2021-2026 we have created an updated 'Pool of Model Conditions'. This document, which is separate to the Statement of Licensing Policy, has been created to assist applicants, responsible authorities or other persons when considering measures to promote the licensing objectives and mitigate concerns. Both documents can be viewed here:

We want to give everyone the opportunity to have their say on the proposed Policy before a decision is made. All feedback received will be taken into consideration by the Licensing Committee when they meet on 23rd June 2021 and decide what recommendations they will make to the Executive and Council.
